Before Using Our Lead Paint
Disclosure Forms, You Should Know These Facts
"Am I selling a residential property in the
U.S.?" and "Is that property built before 1978?"
If you answered "Yes" to both questions, then you are required by law
to give your buyer two lead paint forms - a lead paint disclosure form
and a lead paint pamphlet.
First let's talk about the lead based paint pamphlet. Since it has to
be
EPA approved, there is just one correct version: "Protect Your Family

Next let's move on to your lead paint disclosure.
Home sellers are required by federal law (that means all states) to
reveal any known information regarding the existence and condition of
lead paint in the house. The magic word here is "known", meaning the
seller only has to reveal details that he or she already knows (so
there's
no need to hire a lead paint inspector).
Once you're done filling in the blanks, attach both the lead paint
disclosure form and pamphlet to your Real Estate Purchase Contract.
You must give the buyer 10 days to carry out a lead paint inspection,
unless the buyer is kind / casual enough to waive this right.

Lead Paint Disclosure Form
LEAD WARNING STATEMENT
Every purchaser of any interest in residential real property on which a
residential dwelling was built prior to 1978 is notified that such
property may present exposure to lead from lead-based paint that may
place young children at risk of developing lead poisoning. Lead
poisoning in young children may produce permanent neurological damage,
including learning disabilities, reduced intelligence quotient,
behavioral problems and impaired memory. Lead poisoning also poses a
particular risk to pregnant women. The seller of any interest in
residential real property is required to provide the buyer with any
information on lead-based paint hazards from risk assessments or
inspections in the seller’s possession and notify the buyer of any
known lead-based paint hazards. A risk assessment or inspection for
possible lead-based paint hazards is recommended prior to purchase.
SELLER'S DISCLOSURE

(ii) [ ] waived the opportunity to conduct a
risk assessment or inspection for the presence of lead-based paint
and/or lead-based paint hazards.
