When a real estate seller (grantor) signs
this deed over to the buyer (grantee), he or she is saying, "I own this
property and have the right to hand it over to you. I make no
promises that the property title is free from debts or claims. If the
property title does run into any trouble, then too bad pal that's your
own problem."
If you are selling property, this deed should be your first choice for
a worry-free sale (if you can somehow convince the buyer to accept
it).
On the other hand, it's easy to see why a property buyer
should avoid it unless you really have no choice. For a deed that will
cover your ass better, we strongly recommend that you insist on a General Warranty Deed (best
protection) or Special
Warranty Deed.
